LOUISIANA UNDER SIEGE BY MISSISSIPPI RIVER!
Randy Newman’s song, Louisiana 1927, hit home to many residents up and down the Mississippi river this week. He was singing about the 1927 flood, where more than 23,000 square miles were inundated, hundreds of people died, and hundreds of thousands were left homeless. As of right now, predictions are that water levels up and down the river will exceed those reached in the 1927 disaster. And no one really knows how bad it will get.
It has been abnormally hot this spring throughout the south. A number of states have seen three times the normal amount of rain. But along with the downpours, there have been droughts and wildfires. Then came the tornadoes in all time record numbers that killed at least 309 people and caused massive destruction. Insurance losses are now projected to exceed $6 billon, with a similar amount for homes that were either under insured, or not insured at all.
The heavy spring rains have been incessant up and down the river, and there are projections for more Midwest thunderstorms later on this week. And all this water has, over the years, been channeled in tight levee systems that are right now under massive pressure. Author John Barry, who has been a guest on my radio show on several occasions, documented the dangers of flooding on the Mississippi in his award winning book, “Rising Tide: The Great Mississippi river Flood of 1927 and How it Changed America.” I asked him about his concerns today. “I know the power of this river, and quite frankly it makes me nervous to see this much water on the move,” he says. First of all folks it has come to my attention there is a missing episode of Magnum J.D. starring Eric Paulsen, Diane Hollis, Phyllis George, Dr. Laura Badeaux, Cindy Cenac, Julie Quinn, Faith Peperone, Sonia Perez, Kathleen Diamond and Elizabeth Dent. According to my sources, screen writer Nell Nolan had the ladies situated poolside enjoying the fine spring day over at Mag’s place on St Chas. A tip of the Slabbed hat to several readers on the disappearance of the episode which also has Magnum out of town trying to ascertain his real place of birth.
Next up is Saints Owner Tom Benson getting the pope to genuflect before him and kiss his Super Bowl ring. Folks in Catholicism these days the times they are a changin’.

In late 2008/early 2009 the Nation was captivated by the judicial bribery prosecution of Dickie Scruggs, his son Zach plus the greedy stooges in Tim Balducci and Steve Patterson among others. In a way the genesis of Slabbed lie in those events as Team Insurance, through various shills such as Portland Oregon Lawyer David Rossmiller took the opportunity to rat fuck the folks down here on the coast whose only “crime” was losing their homes to a hurricane and expecting their insurer to honor their contracts.
There has been a fair amount about the Scruggs prosecution documented on these pages, mainly by the now on hiatus Nowdy who used the term Just Us justice to describe the behind the scenes rat fuck of Zach Scruggs in particular and indeed before she departed wrote of Zach Scrugg’s attempt to have his guilty plea overturned based on the case facts and an intervening Supreme Court decision.
I’ve never had much of an interest in the carrying on of a bunch of power lawyers 300 plus miles away in North Mississippi before the folks down here on the coast got used as cheap props in the Scruggs scandal and believe me I come not to defend Dick Scruggs as he represents the worst of the legal profession in how he conducted himself professionally. That said I’m now beginning to wonder how much company he should have in the federal pen because it is becoming very clear some of Scruggs’ loudest critics aren’t much better people and this includes the US Attorney’s Office for the Northern District of Mississippi which even tried to eat its own young in the bogus prosecution of FBI Agent Hal Neilson last year.
I’ve been sitting on information about the Scruggs saga for well over a year. Frankly with the revelations that the US Attorney’s office in Oxford seemed more interested in cashing via writing a book than doing justice in USA v Scruggs, the more recent revelations of prosecutorial misconduct in the case comes as no surprise. This is a topic that is beginning to call me, especially with news today that AUSA Bob Norman was disqualified by Judge Biggers from USA v Zach Scruggs for withholding information from the court salient to the case.
I personally think Zach knew about the bribe just as surely as the senior folks at Nutt and McAllister did, but I do not think the government had the evidence to prove it. When things slow down a bit I’m going to review this case. It is becoming too compelling not to take a second looksie.

Here in Mississippi our Insurance Commish doubles as the State Fire Marshal. Commish Mike Chaney just made the news wearing his Fire Marshal hat in fact, as it relates to the recent cabin fire at the Neshoba County Fairgrounds. Now given the hit job former deputy commish turned State Farm lawyer Lee Harrell did on the Rigsby sisters that was extraordinary in the complete lack of professionalism that went into the finished product, one wonders what would happen if legal determinations associated with a fire causing fatality could cause an innocent man to be executed here in Mississippi like happened in Texas a few years back. The implications are quite disturning IMHO.

Update: Mr CLS sent us a Slab-o-gram and as usual it was spot on. Following his tip I found this story about Tanzie. She is evidently a lying sack of shit herself and political hack to boot. Here is an excerpt:
Jones, who briefly filled the same role for Mayor Ray Nagin in 2004, had been working as an aide to Murray’s legislative colleague, state Sen. Ann Duplessis. Jones left Duplessis’ staff about a month ago.
She handled media relations for state Rep. Cedric Richmond during his short-lived run for the City Council in 2005 and signed on as a volunteer with the mayoral campaign of Lt. Gov. Mitch Landrieu, who failed to unseat Nagin in 2006. Before she was hired by the city, Jones worked as an assignment editor for ABC-26 News.
After joining Nagin’s staff as a media relations assistant in March 2003, Jones took over as press secretary in August after two of her superiors resigned. She stepped down three months later in the wake of revelations that she claimed a college degree on her resume that the University of New Orleans said she never earned.

Want to be on an exclusive MDL plaintiffs’ steering committee? Then you need to be an attorney in a large plaintiffs firm—the type that generally does not exist in Mississippi. That’s my take away from reviewing the list of attorneys on the Plaintiffs’ steering committee in the BP Oil Spill MDL.
Here is Judge Barbier’s Order rendered Friday with the names of the fifteen lawyers on the plaintiffs’ steering committee. Most of the lawyers appointed to the committee practice with large plaintiff firms. The even more exclusive executive committee is composed of four lawyers: James Roy, Russ Herman, Brian Barr and Scott Summy.
My interpretation of the Order is that the steering committee will run the entire litigation. Lawyers who represent victims—but who are not on the steering committee—appear to be getting squeezed out of the litigation.

The board found that respondent knowingly violated duties owed to the public and the legal system. Respondent made a false statement in an affidavit when he signed the 2005 Notice of Candidacy form stating that he was domiciled at 8701 Lomond Road. Respondent refused to acknowledge or correct this misrepresentation during the civil trial that challenged his candidacy. Instead, he tried to blame other parties or twisted his testimony to suit the circumstances. Furthermore, respondent is an elected official, representing the 101st legislative district in the Louisiana House of Representatives. He refused to acknowledge the qualifying rules regarding domicile in the election for Council District D. The resulting civil trial challenging respondent’s candidacy burdened the legal system unnecessarily. Under the ABA’s Standards for Imposing Lawyer Sanctions, the board found the baseline sanction for respondent’s misconduct is a suspension from the practice of law……….
We find respondent’s statement of domicile in the 2005 qualifying form was false, and that after his candidacy for office was challenged, he made similarly false statements regarding his domicile in pleadings and oral testimony in the election contest. Moreover, we accept the hearing committee’s factual finding that respondent’s misconduct was knowing……

Over the past couple of days I’ve saved links to several stories pieces from the Times Picayune, two from the opinion page and one from the news department. Our readers will recall last week we had a bit of fun with T-P columnist Stephanie Grace, who evidently has never met a politician, crooked or otherwise she failed to like so I guess it was natural I was tickled when T-P columnist/editor Drew Broach entered the fray from the perspective of the school board races in a column that is well worth featuring here on Slabbed. Here is a snippet:
Don’t tell me that Jefferson Parish is fed up with its School Board. Not when four of every five voters skipped the election. If anything, turnout would suggest that Jefferson Parish doesn’t much care about the governance of public education.
But, yes, the few who did vote Oct. 2 demonstrated they are indeed fed up and aren’t going to take it anymore. “That” being a school system ranked one of the worst in Louisiana.
Yep, and I bet just like the schools in Orleans Parish back in the day, the system in Jefferson Parish is being systematically looted by the folks charged with running it. Once back in the day when I audited public school systems, I compared the per pupil expenditures of a district I was auditing in Mississippi to the one in Cleveland Ohio. There were no similarities as the racially mixed district I was auditing scored around the national average in standardized test scores while the Cleveland Ohio system was in the bottom quartile despite spending over $12,000 more per pupil. Like Orleans Parish, meaningful change will not come to the Jefferson system IMHO until someone from the outside such as the state takes it over and cleans house. Read more…

My calendar was marked with the due date for Allstate’s Answer to the Branch SAC (Second Amended Complaint); and, given the Allstate Motion for Extension of Time…and…Page Limits, I expected the “good hands” to mix things up:
In its notice of nonintervention filed in Denenea, the Government stated that ‘with the addition of Allstate as a defendant in Branch Consultants, the question of whether the jurisdictional bar under 31 U.S.C. § 3730(b)(5) is triggered as to either the relator in Denenea or the relator in Branch Consultants arises’…Allstate seeks a ten day extension of the deadline for it to respond to the SAC so that Allstate may address the impact of the Denenea action on the viability of the SAC’s claims against Allstate…
Allstate also respectfully moves for an extension of the page limit…In addition to the issues raised by the Denenea action, Allstate’s motion will address the first-to-file, res judicata, and law of the case issues raised by the Rigsby complaint and this Court’s and the Fifth Circuit’s prior rulings dismissing Allstate under the first-to-file rule.”
Allstate, however, did more than just mix things up. The Company’s Answer to the Branch complaint reads as if Abbott and Constello were heading Allstate’s legal team and offering who-filed-first as a defense! Read more…
