With reference to the documents:

RECORD OF DECISION FOR LIBBY ASBESTOS SUPERFUND SITE THE FORMER EXPORT PLANT OPERABLE UNIT 1

LINCOLN COUNTY, MONTANA, and the same document for Operable Unit 2 of the same site:

In these documents there are specific references to ARI Technologies, Inc. and thermochemical conversion technology and the application of this technology for the destruction of asbestos waste.

Please provide the following:

1. The source of all information used by the EPA to describe ARI Technologies and thermochemical conversion technology for the destruction of asbestos including copies of the information obtained by EPA and the source of this documentation,

2. How EPA evaluated and assessed the concept of "irreversibility" of products produced from thermochemical conversion technology and how EPA evaluates the products from waste treatment technologies to determine if the product has been irreversibly destroyed/converted and how EPA determined that thermochemical conversion technology had not been adequately assessed for irreversibility of its treated product,

3. The names, titles and addresses of EPA employees who are responsible for gathering, assessing, writing and publishing any and all information related to ARI Technologies and thermochemical conversion technology in the above-mentioned RODs,

4. Where and how EPA obtained information regarding the claimed use of hydrofluoric acid in the process of thermochemical conversion,

5. How EPA determined the cost for implementation of thermochemical conversion technology as a potential cleanup option for the Libby site and the costs used by the EPA that were a basis for eliminating thermochemical conversion technology from further consideration as a cleanup alternative,

5. How EPA arrived at the conclusion that in order to treat the asbestos waste from the Libby site using thermochemical conversion, the waste would have to be transported out of state and that the treated products would have to be transported back to Libby following treatment,

6. The transportation costs that EPA referenced in the ROD and the source of these costs identified for such transport,

7. The definition of "relatively new" as used in the ROD to describe thermochemical conversion technology and how this term is used to assess whether or not to implement waste treatment technologies on Superfund sites,

8. How EPA determined that thermochemical conversion technology could not be implemented on site,

1. The subject of the records requested concern the development and publication of a Record of Decision by the U.S. Environmental Protection Agency. This is an operation undertaken by the government.

2. The contents of the ROD are not adequately explained and the ROD appears to have grossly incorrect and egregious errors. The requested documentation will contribute to an understanding how how such errors could be present in such an important document.

3. The ROD affects the public health and welfare of the citizens of Libby, Montana.

Disclosure of the requested information will assist the public in understanding how EPA has used incorrect and faulty information to protect the public.

4. The contents of the ROD affect the public health of the citizens of Libby, Montana. If EPA cannot adequately explain how so much incorrect information ended up in a Record of Decision, it will have a significant impact on public health.

5. Regarding commercial interest, the contents of the ROD appear to be wanton and willful misrepresentation of facts that will cause irreparable harm to ARI Technologies, Inc.

6. The primary interest in disclosure is to inform the public how millions of dollars can be spent to produce a document, the contents of which appear to be comprised of creative writing rather than objective, diligent and scientific evaluations.
