Story Sent to KansasCityNBA@apwu.org from Naidra Barbieri, regarding on the job injuries and harassment and denial of rights. It seems that the Kansas City NBA is ignoring this horrific story of an injured postal work denied civil rights, human rights and harassed over injures receive don the job by United States Postal Workers, Managers such as Sheila M. Smith Plant Manager
The Naidra Barbieri Story has also been sent to Senator Claire McCaskill, Senator Roy Blunt, Congressman Blaine Luetkemeyer, Rob Strunk APWU Director, David Martin Gateway District and has been seemingly ignored.
Those internally involved and ignoring this issue, seem to me to be Alan Sommers, Kerri Peirson, Sheila M. Smith Plant Manager, Lorango Fleming, Madonna R. Hermann, Christine Bartholf, Sue Gardner APWU President, Mike Dolson, Lee Hudson, David L. Sprague, Jessica Tennon, Debbie Cisean, George B. Stanek, all seemingly working for the US Postal Service out of Columbia MO.
The Naidra Barbieri Story is about extreme duress and harassment over being injured at work and being pressured by management to simply shut up about it no matter the level of pain. The Naidra Barbieri Story is also about sexual harassment, and a complete lack of Civil and Human Rights and from a USPS Employee of nearly a decade. Naidra Barbieri has certainly paid her American Postal Workers Union ( APWU ) dues, however Naidra Barbieri seems to be getting no where through the alleged proper channels.
Though Kansas City NBA, and Sheila M. Smith Columbia MO Plant Manager is aware of Naidra Barbieri and her disability, they continue to ignore her rights and the USPS management simply harasses her, threatens her and seems to be accountable to no one.
Soon the Kansas City NBA as well as Sheila M. Smith,Doug Roberts, Tanya Linder, Alan Sommers, Kerri Peirson, Sheila M. Smith Plant Manager, Lorango Fleming, Madonna R. Hermann, Christine Bartholf, Sue Gardner APWU President, Mike Dolson, Lee Hudson, David L. Sprague, Jessica Tennon, Debbie Cozean, George B. Stanek of Columbia Missouri, will be under a Department of Justice Investigation, OSHA Investigation, Workers Compensation and Department of Labor Investigation as the Naidra Barbieri Story involved unsafe work conditions, harassment by supervisors, ignoring of threats at work, unbearable work conditions, discrimination, denial of pay, and harassment of postal workers they are supervising.
Following is a letter from Naidra Barbieri, many more documents and documentation will be posted soon, as the Naidra Barbieri story affects all Union Workers Rights, all USPS Postal Workers Rights and the violation of Naidra Barbieri's Civil and Human Rights.
Complaints will soon be filed with the Department of Labor, Department of Justice, OSHA, OWCP, APWU and more from sources other then Naidra Barbieri on her behalf to expose injustice at the Columbia Missouri USPS and the management that is ignoring this case and denying Naidra Barbieri her rights, dignity and respect. There also hopes to be a Federal RICO Complaint filed and a HIPAA Lawsuit against all these people individually and professionally.
Naidra Barbieri Letter Below
"My name is Naidra Barbieri, and I have had several issues at work with no support from my union. I don't know how to proceed, without contacting someone that will support me.
I have been working in Columbia Missouri since 2007. In that time, I have had 3 accidents. 2 of which were caused by other employees running equipment into me, and one was because my manager put me into a job that I was not physically capable of doing (due to the first accident).
I am currently off work, because on December 8, 2011, another clerk shoved some equipment into me while I was taking mail to another area (this was the 3rd accident). I am not able to work, this should be workers comp, and my managers are harrassing me about the paperwork that I've turned in.
I have repeatedly asked my stewards for help. Sue Gardner, president, has not helped me with several issues so I know that she won't help me with this. Another steward, Mark Hiatte has been asking for statements from my co-workers against me, because he is trying to support the employee that caused this accident.
I have many issues going on, which lead to confusion. The first accident that I had was in January 2010 when a mailhandler ran into me from behind with an loaded ergo cart, and pinched me between the cart and a safety bar. This left me with extensive damage to my back, and chronic pain.
After that happened, I was excessed to a custodial position, which consisted of duties that I could safety perform. I was given a permanent limited job by Earle Randall, Plant Manager in 2010, and when the new plant manager, Sheila Smith, replaced Earle in September, I was sent back to a clerk position without informing Workers Comp that my duties were changing significantly. This led to my second accident, because I was running equipment that was not within my restrictions, I hurt my knee.
I was asked to be a 204B, which I did for several months. I became unhappy with what I thought were dishonest practices, so I decided to go back to being a clerk.
Approximately July/August 2011, I spoke out at the threat assessment team, with the understanding that what I said would be confidential. Another 204B told me that Sheila and the union received packets of information from the team, which included each employee and the statements they gave.
Since that time, in my opinion, I have been harrassed. Mainly management requested medical documentation repeatedly. The same documents. Many things have been lost, or I've been accused of not turrning in.
I can assure you that I have kept ALL documentation regarding my work and my medical condition. I have turned in documentation EVERY TIME I've seen a doctor, which has been too many to count.
I have been off work since January 5, 2011, due to complications from the last accident. When the employee ran into me I knew that no doctor, besides my own, could help me, so I declined to go the ER. I told my supervisor that I would be seeing my doctor when I got off work. (I called my doctor right after it happened, because I was in so much pain). I was off work for 4-5 days, having to use my own SL, in fear of retaliation, and knowing I would get no union support. I was hoping that after 4 or 5 days of rest I would recover and be able to get back to work. Because my back was injured, I had to walk differently, and that placed more stress on my left knee, which gave out completely last week. I had to have an MRI on my knee as well.
I have received a letter that my latest medical documentation is not sufficient and that I have 5 days to turn something else in or my absence could turn into an AWOL. The documentation that I turned in stated that I was incapacitated due to left knee pain. It also states that it is uncertain when I will be able to return to work, and that I am 'incapacitated for 2 weeks...knees immobilizer and crutches...no weight bearing left knee....return for re-evaluation 2 weeks'. I don't know what else they need.....I don't know how they could ask for more information without being a HIPAA Violation.
I have had to use my annual leave, in order to get paid. I am a single parent, and this job means my survival. I have very little leave of any kind left.
I just don't know where else to go. My co-worker, Allan Sommers, suggested that I contact you, because I'm running out of options. I know that I have a complicated situation. I feel that the local union is overwhelmed with my situation, because there are extenuating circumstances. I just don't know where else to go for help.
Please contact me so that we can discuss this further, or at least tell me where else to go. I have thought of contacting state representatives, but I felt that I owe it to my union to try to get some assistance first.
Thank you very much
