"MPEG-LA Launches Patent Attack on Google’s Video Format

MPEG-LA, the licensing organization that collects patent royalties from users of popular video formats, has announced that it is forming a patent pool and gathering claims from companies that believe they have patents essential to the VP8 Codec.

Many see this as a blatant attack on Google’s video format, which the company purchased last year. Following the purchase, Google open-sourced the format so that any person or company could use the technology for free. Google currently uses the technology in its new web media format known as WebM.

MPEG-LA has commented that the call for patents is to facilitate communication among companies that own such patents to see if a patent pool is desirable. The idea behind a patent pool is that companies can execute a single license with MPEG-LA to use the technology, rather than having to go to potentially dozens of companies to make deals. Google has responded that the company will continue to support free and open development, which it contends are principles that the WebM Project brings to web video. Google representatives have stated that they are in the process of forming a coalition of hardware and software companies who will commit to not assert any IP claims against WebM.

While Google’s firm stance on promoting open development is admirable, the company will likely face litigation should legitimate patent-holders come forward. A major key to the controversy will likely be whether rival tech corporations to Google will support the patent pool. However, if the majority of the industry does support free and open development as Google contends it does, MPEG-LA may not be able to generate enough interest in or commitment to a successful patent pool. A crucial date for the resolution of this issue will be March 18, which is the deadline for potential patent holders to respond to MPEG-LA’s request."
